We use the terms ‘we’, ‘us’ and ‘our’ to refer to ARS, LLC d/b/a Platinum Member Benefits (“ARS”), which owns and/or operates this website, and our employees, members, officers, partners, affiliated entities, subsidiaries, divisions, contractors, representatives, attorneys, and agents.

In order to better serve your needs now and in the future, we may ask you to provide us with certain information. We understand that you may be concerned about what we will do with such information – particularly any personal or financial information. We agree that you have a right to know how we will utilize such data. Therefore, we have adopted this Privacy Policy to govern the use and handling of your personal information.

This Privacy Policy governs our use of the information that you provide to us or we otherwise obtain in providing our products and services to you. In order to provide the products and services you request from us, we may partner with third party service providers, who are governed by their own Privacy Policies. We are not responsible for the policies or practices of third parties.

Types of Information

Depending on which of our services you are utilizing, the types of information that we may collect include:

Personally Identifiable Information, such as your name, address, email address, credit card information, and other personally identifiable information, we receive from you on applications (either applications with us directly or through our partners), forms and in other communications to us, whether in writing, in person, by telephone or any other means, and information about your transactions with us, our affiliated companies, or others; and

Non-personally Identifiable Information, such as the Web site’s Uniform Resource Locator (“URL”) that you just came from, which URL you next go to, what browser you are using, and your Internet Protocol (“IP”) address. This type of information does not by itself identify a specific individual and is used on both a personal and aggregate basis for service delivery, analysis, and marketing.

Use of Information

We request information from you or obtain information about you for our own legitimate business purposes and not for the benefit of any third party. Therefore, we will not release your information to any party, whether affiliated with us or not, except: (1) as necessary for us to provide the product or service you have requested; (2) communicate with you regarding service offerings; or (3) as permitted by law. We may, however, store such information, including during the period after which any customer relationship has ceased. Such information may be used for any internal purpose, such as quality control efforts or customer analysis.

 

When you use our website, we will store cookies on your computer in order to facilitate and customize your use of our site. A cookie is a small data text file, which a website stores on your computer’s hard drive (if your Web browser permits) that can later be retrieved to identify you to us. The cookies make your use of the site easier, make the site run more smoothly and help us to maintain a secure site. If you want to update or correct information you have provided us, you may do so under the My Account section during your secured login session or by contacting customer service at 1-954-666-5302. If you find any information in the benefits provided as part of the Services that you believe is incorrect and wish to correct it, you can do so by contacting customer service, see “Contact Us” on the website.

Former Customers

Even if you are no longer our customer, our Privacy Policy will continue to apply to you.

Confidentiality and Security

The confidentiality of your nonpublic personal information is important to us. We will use our best efforts to restrict access to your nonpublic personal information to those individuals and entities that need to know that information to provide products or services to you. All information transmitted to the Website utilizes SSL-encryption technology. However, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure and you acknowledge that there are security and privacy limitations of the Internet which are beyond our control. We make no warranty, express, implied, or otherwise, that we will prevent unauthorized access to your private information. Through our partnerships, we currently maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information.

Terms of Service Agreement | February 2019

You (“ you”, “ your”, “ yours”, “ member”) have requested to enroll in, register, sign up or subscribe (collectively, “ Enroll” or “ Enrolled”) for a service or product provided by ARS, LLC d/b/a Platinum Member Benefits (“ARS”), including its parent companies, subsidiaries, affiliates, divisions, contractors and all data sources and suppliers (collectively, “Platinum Member Benefits”, “we”, “our”, “us”).

TERMS AND CONDITIONS

You must read these Platinum Member Benefits terms and conditions (“Service Terms”) carefully before you Enroll and use the Services defined in this agreement. These Service Terms are a legally binding agreement between Platinum Member Benefits and you and define the terms that you agree upon to use Platinum Member Benefits Services. Each of the various products and services offered by Platinum Member Benefits, including Savings Plans, Involuntary Unemployment Insurance, Identity Theft, VIP Hotel and Resort Plans, and Roadside Assistance, among others. Examples of Savings Plans include coupons, rebates, exclusive buying clubs and other opportunities to obtain free or deeply discounted goods or services (“Savings Services”). Examples of Insurance services and products include Involuntary Unemployment Insurance programs that can make loan, mortgage, or credit card payments on your behalf, or pay you an agreed upon monthly payment if you should become involuntarily unemployed during the period of coverage. Examples of Identity Theft Services and/or products may include Identity Theft Monitoring, identity theft insurance, identity theft information and identity theft assistance (“Identity Theft Services”). Examples of VIP Hotel and Resort Plans services and products include exceptional pricing on various hotels, resorts and vacation opportunities from some of the most popular brands in worldwide hotels and resorts, as well as unique and rare opportunities at exclusive and private vacation spots (“Hotel/Resort Services”). Examples of Roadside Assistance products and services include emergency 24/7 roadside assistance, towing, a flat tire change, car battery replacement, car locksmith, gas delivery and more (“Roadside Services”). These examples and any other services or products that may be made available to you by Platinum Member Benefits are collectively referred to as our Services. (collectively, “Services”).

WEBSITE TERMS OR USE

The information on Platinum Member Benefits websites (“Website” or “Websites”) is intended as a convenience to provide you with information about our Services and a method to Enroll. Once you are Enrolled, you will have access to a password secured member website (“Member Site”) where you must go to access your Enrolled Platinum Member Benefits Services. Access to the Member Site will continue if you are Enrolled and paying for Services. Your access to the Websites is provided “as is”. The Websites and Member Site may also be available as a full or partial featured version through your smart mobile phone.

The copying, framing, mirroring, scraping or data-mining of our Websites or any of its contents in any form or by any method is strictly prohibited. Access to our Websites does not grant you any right, license or privilege to reproduce, publish or use any material from the Websites or any property of Platinum Member Benefits except as expressly set forth herein. Any ideas, concepts, techniques, procedures, methods, systems, designs, plans, charts or other materials you transmit to us through e-mail, phone, or our Websites will become our property and may be used by us at any time and for any purpose, without restriction, unless otherwise agreed by Platinum Member Benefits.

By using our Websites, you agree not to restrict or inhibit anyone from using or enjoying our Websites. In your use of our Websites, you shall not knowingly nor negligently transmit any viruses, malware, trojan horses, worms, time bombs, cancelbots or other similar harmful or deleterious programming routines.

ELECTRONIC AGREEMENT & ENROLLMENT

When you Enroll, you represent that you are a natural person at least eighteen (18) years of age and residing in the United States or its territories. You further agree to provide Platinum Member Benefits with personal information necessary to access and provide our Services to you. Some Services provide by Platinum Member Benefits may include the option to enroll your minor children provided you are the parent or legal guardian.

YOU UNDERSTAND THAT IT MAY BE A VIOLATION OF LOCAL, STATE AND FEDERAL LAW FOR YOU TO OBTAIN A CREDIT REPORT FOR ANYONE OTHER THAN YOURSELF. Except for the enrollment of your minor children, you warrant that you are enrolling for yourself and not on behalf of any other individual. You agree that your use of these Services does not violate applicable laws and that you agree with these Service Terms and the Platinum Member Benefits Privacy Policy. You further agree that your use of the Services constitutes your acceptance of these Service Terms. If you do not agree to these Service Terms, you must not Enroll.

Platinum Member Benefits reserves the right to refuse to allow you to enroll in certain circumstances that may apply to you such as a history of misusing our Websites, creating phony enrollments in a Platinum Member Benefits Service, misusing Platinum Member Benefits Service special offers, filing fraudulent credit card chargeback requests on a previous Platinum Member Benefits Service or non-payment of Services.

To Enroll in a Platinum Member Benefits Service, you must visit a Platinum Member Benefits Website or some other method we expressly permit. As a convenience to you, Platinum Member Benefits may provide internet links to websites owned or operated by other entities and persons. If you use these websites, you do so at your own risk. Platinum Member Benefits makes no warranties or representations regarding these websites, and shall not be liable or responsible for, any linked websites, your use of such sites, or the comprehensiveness or accuracy of information or materials appearing thereon, or any products, publications, subject matter or services described thereon. Furthermore, links do not imply that Platinum Member Benefits sponsors, endorses or is affiliated or associated with such sites, or that any linked website is authorized to use any trademark, trade name, logo or copyright of Platinum Member Benefits.

To start your Enrollment process (“Process”) you will need to click a Website button such as “start membership” from a Platinum Member Benefits Website. The Process will prompt you to provide personal information such as your full name, birth date, residence address, email address, social security number (for certain Services) and payment card information. Entering and maintaining accurate information during and after Enrollment is critical to the accuracy and availability of the Services we provide to you. Examples of how inaccurate information may affect your Platinum Member Benefits Services include; non-delivery of Service alerts due to an incorrect email address, inaccurate credit reports due to incorrect personal information or temporary deactivation of services due to failed charges associated with outdated payment card information. If your personal information changes, you must keep it up to date so that your Services are not negatively impacted. You may update your personal information from the Member Site or by calling Platinum Member Benefits customer service. Platinum Member Benefits is not responsible for inaccurate personal information you enter that may affect your Services. During the Process, if you are purchasing Identity Theft Services, you will be prompted to complete a one-time identity authentication. If you do not successfully complete the identity authentication, you will be prompted to contact Platinum Member Benefits customer service by phone at the soonest possible time to complete the process manually. Provided you completed the rest of the Process successfully, you will still be Enrolled. However, you will have limited access to the Services you enrolled in such as Credit Services until the identity authentication is completed. If you do not complete the identity authentication within a reasonable timeframe we may automatically cancel your account. Once you have completed your Enrollment and payment to us for any fees you owe, you are considered a Member and will be eligible to access the Services which you have enrolled in.

SERVICES & PRODUCTS

Platinum Member Benefits Services are offered in plans (“Plan” or “Plans”) that generally include one or more benefits or features (“Benefits”). Certain individual Services such as a credit report may also be offered as a one-time or one-shot purchase (“A la carte”). Each plan may contain a different arrangement of Benefits. To determine which Plan or A la carte purchases you are enrolled in, see the list in your Member Site. Below is a list of Plans, products and services presently offered by Platinum Member Benefits, which offerings may change from time to time.

ANY PERSON USING DECEPTION TO KNOWINGLY AND WILLFULLY OBTAINS A CONSUMER CREDIT REPORT, SCORE, CREDIT SERVICES OR SCORE MAY FACE CRIMINAL PROSECUTION.

Everyday Grocery Savings, Discount Movie Tickets, Online Local savings, Auto Buying Service and Maintenance Discounts, Vision and RX discounts and much more.

Involuntary Unemployment Insurance Plan

In the event of becoming unemployed involuntarily, the Involuntary Unemployment Insurance (IUI) benefit will make payments to you.

IDENTITY THEFT SERVICES

Some Plans may provide you with the availability of Identity Theft Services (“Identity Theft Services”). This may include but is not limited to identity theft monitoring and alerts, identity theft insurance, identity theft information and assistance.

Identity Theft Monitoring – Your Identity Theft Services may include one or more types of identity Theft Monitoring (“Identity Theft Monitoring”). Types of Identity Theft Monitoring may include but are not limited to: criminal records, dark web, social security number, change of address and loan application. Identity Theft Monitoring will generally monitor for certain activity tied to your personal information that could be the precursor to credit fraud or identity theft. In some cases, you may need to manually activate your Identity Theft Monitoring services from the Member Site. The Member Site will indicate when your Identity Theft Monitoring has become active. Our Identity Theft Monitoring may be provided to you through 3rd party providers. If a monitored event occurs, we will attempt to electronically alert you by email and/or text. A more detailed report associated with the alert may be available from the Member Site. By agreeing to these Service Terms, you acknowledge that Platinum Member Benefits cannot monitor for all the possible ways your identity could be breached, and that identity protection monitored may not identify all the potential ways that your identity or credit could be fraudulently accessed or used. The type of Identity Theft Monitoring we provide to you may change from time to time.

Identity Protection Insurance – Should you become a victim of identity theft you may be covered for certain losses in accordance with identity theft insurance include in your Plan. Your Plan may also extend this coverage to some of your immediate family members up the limit of the benefit. You may be able to add family member beyond the limit of the benefit at an additional cost. Identity theft insurance is provided through a licensed 3rd party insurer. All insurance service claims and specific insurance customer service will be provided through the 3rd party insurance provider. To file a claim, contact Platinum Member Benefits customer service at the number provided from your Member Site. The customer service agent will provide you with contact information to the 3rd party insurance provider where you can file your claim. If your Plan includes identity theft insurance, you agree to such insurance coverage and that the premium for such insurance coverage will be paid by us on your behalf. You agree to receive notices of insurance changes electronically.

Identity Protection Service Assistance – If you believe you are the victim of identity theft, your Plan may include access to a Platinum Member Benefits Identity Theft Specialists. The Identity Theft Specialist is available to answer questions about identity theft monitoring alerts and questions about handling identity theft events within the limits of the Plan you purchased.

VIP HOTEL AND RESORT PLANS

Free $500 credit towards hotel and resort stays in the US and Canada. Whether you’re planning a business trip, your next family vacation, or you just want to jump in the car and get away with that someone special, with hundreds of thousands of hotels to choose from, worldwide, TravNow has you covered.

ROADSIDE ASSISTANCE

PAYMENT

Before you can use Platinum Member Benefits Services, you must Enroll and pay service fees (“fees”, “costs”) associated with the Plan or Ala a Carte purchase you choose. Fees for a Plan or A la carte purchase may involve a one-time annual cost, or a recurring charge based on subscription Services. If your Plan involves a recurring charge, you may be provided with the option to pay monthly, quarterly or annually.

By agreeing to these Service Terms and in accordance with our Privacy Policy, you agree to provide an accepted credit or debit card (“Payment Card”) in good standing. Your Payment Card will be retained and stored by us for use when you first Enroll or make any purchase in our Services. Your Payment Card will be charged immediately when you first Enroll. If applicable, your Payment Card will also be used for the automatic renewal of recurring Service fees you have purchased. If your Payment Card information changes or you prefer to use an alternate Payment Card, then you are responsible to update the information at the Member Site or by calling Platinum Member Benefits customer service. We reserve the right to (a) verify that your Payment Card is authorized for fees prior to processing any purchase or renewal from you, (b) access automatic updates of your Payment Card information electronically from your bank provider, (c) retry failed payments in order fulfill your Services payment obligation.

If your Payment Card fails when a service fee is charged, benefits in your Plan may be temporarily placed on hold until your payment(s) are successfully processed. UNSUCCESSFUL PAYMENTS FOR YOUR RECURRING SERVICES WILL ACCRUE AND DOES NOT CLOSE YOUR ACCOUNT. YOU AGREE THAT Platinum Member Benefits HAS NO LIABILITY FOR 3 RD PARTY FEES YOU MAY INCURE WHEN YOUR PAYMENT METHOD TO US FAILS OR IS REJECTED FOR ANY REASON INCLUDING ISSUFFICENT FUNDS. EXAMPLES OF FEES YOU COULD BE RESPONSIBLE FOR INCLUDE OVERDRAFT AND/OR OVER-THE-LIMIT CHARGES OR OTHER BANK FEES.

In all cases, you are personally responsible for any local, state, federal or other taxes that may be associated with your purchases of our Services. We also reserve the right to collect such taxes at the time any purchase is processed with your Payment Card.

SERVICES TERM

The term of time that your Services will last will be provided to you when you Enroll and from your Member Site. A la carte and some Plans you purchase may be a one-time purchase. Other Plans are considered a recurring monthly subscription purchase. Unless you cancel, or your account is terminated, your recurring Plan will automatically continue indefinitely or until its published expiration date if applicable. You will be responsible to pay the recurring cost of the Plan when you Enroll and each month thereafter.

CANCELLATION & REFUND

You may cancel your Services and/or close your account at any time during regular business hours by calling Platinum Member Benefits customer service at the phone number published in the Member Site. To cancel, we must verify your identity during the call. Once your account has been cancelled any identity theft insurance and/or monitoring associated with your Services will immediately be discontinued. You may in some cases still have access to login to the Member Site to use certain features or make future purchases. However, you may not have access to the various benefits associated with Plan you cancelled such as Identity Theft Monitoring, credit monitoring and credit reports.

SINCE SERVICES ARE MADE AVAILABLE TO YOU UPON ENROLLMENT OR PURCHASE AND COSTS ARE INCURRED BY US, WE DO NOT PROVIDE REFUNDS.

Platinum Member Benefits reserves the right to cancel or terminate Services to you upon notice and with or without cause.

ACKNOWLEDGEMENTS & AUTHORIZATIONS

Modifications

Platinum Member Benefits reserves the right to modify these Services Terms and our Services at any time for any reason. If this Service Agreement or our Services are modified, and you are affected, then we will make a reasonable effort to notify you by posting the changes to the Member Site. To see such a posted notice, you must login to the Member Site. However, you understand and acknowledge that we have no responsibility to provide direct notice of any changes to these Service Terms or the Services you purchase. If you disagree with a change, your only option will be to cancel your Services.

Re-Agreement to Service Terms

In some circumstances, you may be prompted upon login to the Member Site to re-agree to these Service Terms. This could occur if the Service Terms have been modified or a period of time has elapsed since your original Plan enrollment. In such an instance, you must re-agree to the Service Terms to continue your Services. If you disagree and do not wish to re-agree to the Service Terms, then your only option will be to cancel your Services.

Services Not Offered

You acknowledge that Platinum Member Benefits does not provide; credit counseling, debt management, legal advice, tax advice, financial advice, credit repair or credit advice. Platinum Member Benefits is not a lender or insurance company.

Outcome & Expectation of Services

You acknowledge that Platinum Member Benefits is not responsible for the accuracy of your credit report, credit score or any monitoring output. These benefits may be provided by third party services. You are encouraged to dispute any actual or perceived inaccuracies on your credit report by contacting the affected credit bureau. You acknowledge and agree that Platinum Member Benefits will not be liable to you or your enrolled minor children or any 3rd party based on your reliance of or use of any information we provide to you in any communication, alert, educational material, communication, website, customer service conversation or report.

 

Access to Services and System Requirements

To utilize and access Services you are Enrolled in you must use a computer or smart phone with internet access, a web browser and a working email address. Platinum Member Benefits is not responsible in any way or form for your ability to access your email, internet or phone.

Privacy

You acknowledge that we may use your personal information in accordance with our Privacy Policy found on our Websites and by clicking HERE. You further agree that the Privacy Policy is considered a part of these Service Terms. You authorize Platinum Member Benefits and its employees and agents to (a) access and obtain account information and reports about you or your enrolled minor children through our 3rd party services, such as a credit bureau, (b) you authorize Platinum Member Benefits to act on your behalf as your representative for the sole and limited purpose of obtaining information for you to provide you with the Services you are enrolled in with us.

Your Protection & Conduct

The security of your account and data is of the utmost importance. To access our Member Site, you must have a valid login user ID and password. You will receive your user ID and password after you Enroll in one of our Services for the first time. You are responsible to maintain the security and confidentiality of the password associated with your Platinum Member Benefits account. If you forget or feel your password has been compromised, you may quickly reset your password by choosing the “forgot password” option at our Website login or by calling Platinum Member Benefits customer service.

You acknowledge that perfect security does not exist anywhere. As such, you will not recklessly expose your social security number or other personal information to anyone that might misuse it for any purpose that would negatively affect your credit or identity. You further agree that any information you print from the Member Site, such as your credit report, will be protected in a manner like other important documents you may have. Finally, you agree that if you intend to dispose of your credit report or other printed personal information that was printed from the Member Site, that you will use a method that assures the documents cannot be reused by an unauthorized person. A sample of a reasonable method of document disposal include a cross cut document shredder.

Communications

Portions of the delivery of our Services to you may require us to communicate with you in a variety of ways including phone, email, postal mail or text (“Methods”). Examples of communications Methods that we may utilize with you include but are not limited to the following; (a) confirmations and account maintenance communications, (b) monitoring alerts (c) problem with your account, (d) special offers. Communications we send you are provided as a courtesy. Because all communications to you are provided in some way through a third-party communications provider, we cannot guarantee and are not responsible to assure communications we send you are delivered in a timely, complete manner or at all.

By enrolling in our Services, you agree that Platinum Member Benefits and its employees or contractors may contact you by using any of the communications Methods described above. The frequency of communications and/or alerts will vary based on the Plan you are enrolled in and the events that may occur with your account, credit or identity information. You agree to allow us to send you communications after you cancel your service. Such communications may include but are not limited to; (a) ongoing educational information related to our Services, (b) special offers to renew or purchase Platinum Member Benefits services.

You agree to maintain up to date contact information in your account through the Member Site or by calling Platinum Member Benefits customer service. You acknowledge that Platinum Member Benefits has no liability to you; (a) if contact information you have provided is not up to date, (b) if any third-party communication services are not working correctly or at all, (c) for third-party party charges you may incur that are associated with communications we send to you. This includes but is not limited to your third-party communications providers for data, mobile phone or land phone line plans. Text message fees and roaming charges may apply to you through your phone provider. Please contact your mobile phone provider for more details, if any, on these fees. You may have the ability to opt-out of certain communication Methods, such as texting, by changing your preferences at the Member Site or by calling Platinum Member Benefits customer service.

Third Party Offers & Services

You acknowledge that certain services that may be offered in your Plan, such as but not limited to checking accounts reports, may be provide by third parties. Additionally, you may be offered products, services or special offers through the Member Site or through Communications from third parties. These offers are intended to provide you with potentially discounted products or services that may compliment your services at Platinum Member Benefits.

In addition to agreeing to comply with all applicable laws in connection with your use of our Websites, you agree you will not use any such Content or Marks from this Website for any purpose without the appropriate prior written authorization from Platinum Member Benefits.

You expressly understand and agree that your use of our Websites, the Services and Content is at your sole risk. Platinum Member Benefits and its respective suppliers make no warranty that; (a) the services and content are accurate, timely, uninterrupted or error-free; and (b) the results that may be obtained from the use of the Services or Content will be reliable.

You understand and agree that Platinum Member Benefits and its respective suppliers will not be liable for any reason for any direct, indirect, incidental, special, consequential or exemplary damages resulting from or in any way connected to your access to, use, or inability to use the Websites, Services, membership benefits or Content, or from your access to, use, inability to use, or reliance upon any linked website, even if Platinum Member Benefits or its respective suppliers have been advised of the possibility of those damages. Indemnification

By agreeing to these Service Terms, you indemnify and hold Platinum Member Benefits, its officers, directors, employees, contractors, agents, subsidiaries, joint ventures, licensees, marketing partners and other third-party affiliates harmless from any claim or demand including reasonable attorney fees made by any third-party due to our arising from your break of these Service Terms or your violation of any law or regulation or the rights of any third-party.

Export Control

Platinum Member Benefits controls and operates our Services and Websites from our headquarters in the United States of America. The Websites, Content and Services are not intended for sale and may not be appropriate or available for use outside of the United States or its territories. If you use the Website, Content or Services outside of the United States of America you represent and warrant; (a) you are responsible for following applicable local laws, (b) you are not located in a country that is subject to a U.S. Government embargo or has been designated a “terrorist supporting” country, (c) you are not listed on any United States Government list of prohibited or restricted persons, (d) that you are fully responsible for any local taxes or United States tariff taxes that may apply to you.

Binding Arbitration

Platinum Member Benefits believes that any concern or disagreement you have can be resolved by calling our customer service department during regular business hours. If your concern is not addressed, then you understand and agree that all claims, disputes or controversies between you and Platinum Member Benefits, including, but not limited to tort and contract claims, claims based upon any federal, state or local statute, law, order, ordinance or regulation, and the issue of arbitrability, shall be resolved by final and binding arbitration at a location determined by the arbitrator. Any controversy concerning whether a dispute is arbitrable shall be determined by the arbitrator and not by the court. Judgment upon any award rendered by the arbitrator may be entered by any state or federal court having jurisdiction thereof. This arbitration contract is made pursuant to a transaction in interstate commerce and its interpretation, application, enforcement and proceedings hereunder shall be governed by the federal arbitration act (“FAA”). Neither you nor Platinum Member Benefits shall be entitled to join or consolidate claims in arbitration by or against other consumers or arbitrate any claim as a representative or member of a class action or in a private attorney general capacity. The parties voluntarily and knowingly waive any right they have to a jury trial.

Governing Law

These Service Terms and Services provided hereunder will be governed by the laws of the State of Florida, without regard to any laws that would direct the choice of other states laws and where applicable, will be governed by the federal laws of the United States.

Entire Agreement

These Service Terms, the Privacy Policy, and other policies Platinum Member Benefits may post constitute the entire agreement between Platinum Member Benefits and you in connection with your use of our Websites, the Services, and the Content, and supersede any prior versions of the Service Terms, if applicable. The Terms and Conditions are effective until terminated by Platinum Member Benefits. In the event of termination, the Proprietary Rights, Communications, Disclaimers and Limitations of Liability, and Governing Law provisions set forth in these Service Terms will survive. In the event of a conflict between any other notice, policy, disclaimer or other term contained in our Websites, Services or Content, these Service Terms will control. If any provision is deemed to be unlawful or unenforceable, it will not affect the validity and enforceability of the remaining provisions. Electronic Signature & Acceptance of Agreement
